A federal judge in Hawaii just issued a nationwide temporary restraining order to block the revised version of President Trump Travel Ban of Muslims from six countries and a refugee ban. Both judges cited Trump’s statements about Muslims during the presidential campaign as part of their rulings.
The federal court in Hawaii and Maryland have now spoken not once, not twice, and very loudly. No amount of tweaking will undo the discriminatory intent behind the Muslim Ban 2.0. The judge concluded, based on the historical context of the travel ban and public statements made by the president, that “a reasonable, objective observer … would conclude that the Executive Order was issued with a purpose to disfavor a particular religion[.]” Mr. Trump, who used anti-Muslim rhetoric on the campaign trail in his successful run for the White House, will now have to account for those statements in court, with both judges saying the Trump Travel Ban executive order raised the specter of religious bias. “The Constitution has once again put the brakes on President Trump’s disgraceful and discriminatory ban,” said Omar Jadwat, director of the immigrant rights project at the American Civil Liberties Union.
