On June 18, 2024, President Joe Biden announced a new program that will allow certain spouses of U.S. citizens to apply for “parole-in-place” from the Department of Homeland Security (DHS). This program, which is not yet open for applications, will not only allow up to 550,000 people to receive temporary protections and work permits in the United States, but will generally allow them to apply for lawful permanent resident (LPR) status (also known as a green card) through their spouses without risking years of separation from their families.

Currently undocumented spouses of U.S. citizens who entered the USA legally can get legal status in the USA without leaving the USA.  However, undocumented spouses of U.S. citizens who entered illegally (like through the borders) have to file a waiver and leave the USA and return legally before can get legal status in the USA.  President Biden’s executive order will now allow undocumented spouses of U.S. citizens who entered illegally to remain in the USA through a concept called “parole in place” and get their legal status in the USA without leaving the USA and more importantly without separately families.

Requirements for spouses of U.S. citizens & children of U.S. citizens:

  • Must have resided in the United States since June 17, 2014;
  • Must be physically present in the United States on June 17, 2024;
  • Must be legally married to a U.S. citizen as of June 17, 2024;
  • Must have entered the United States without admission or parole and do not currently hold any lawful immigrant or nonimmigrant status;
  • Must not have been convicted of any disqualifying criminal offense;
  • Must pass background checks and not pose a threat to national security or public safety; and

What to expect next?

  • Republicans will most likely challenge Biden executive order in the courts as unauthorized under the U.S. Constitution
  • Application process will be released in late summer
