June 26, 2026: The Supreme Court sided with the Trump administration in an immigration case dealing with the government’s power over green card holder accused of crimes. The 6-3 decision centers on an immigration officer’s 2012 decision to put lawful permanent resident Muk Choi Lau on immigration parole when he returned from a short trip to China because he had been accused of a counterfeiting crime.
The Trump administration argued that suspicion of a crime is enough to put a lawful permanent resident, also known as a green card holder, on immigration parole. Federal attorneys urged the court to take an expansive view of executive authority over immigration.
As a green card holder accused of crimes, Immigration Attorney Gail S. Seeram is not recommending any travel outside the USA as admission into USA will not be granted but instead the green card holder will be paroled into the USA.
What is the difference between “admission” and “paroled”?
Admitted: The individual enters with a recognized lawful status (e.g., as a lawful permanent resident or valid nonimmigrant), acquiring the rights and protections associated with that classification. Individuals are entitled to the full range of legal protections under U.S. laws and are subject to removal (deportation) proceedings if they violate the terms of their status.The government bears the burden of proving that an admitted individual is deportable in formal immigration court proceedings.
Paroled: The individual does not receive a formal legal status. Under the Immigration and Nationality Act (INA), a parolee is still treated as an “arriving alien” who is continuously seeking admission at the border, even though they are physically inside the country. Because a parolee is still legally considered an applicant for admission, they can face expedited removal or be subjected to stricter admissibility tests should a legal issue arise.
